Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed tenancy is signed for a Seaview rental property, all Healthy Homes compliance work must be done within 90 days.

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on a Seaview rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet one of the Healthy Homes Standards within the expected timeframe can result in an amount of $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not incorporated within the renewal, new or revised tenancy agreement, there could be an additional fine or infringement fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the property manager fails to provide the information requested within 21 days of getting the notice, the tenant may be issued an infringement notice and be fined as high as $750.

Additionally, there is also a penalty approximately $900 for property owners or property managers who offer a false or misleading Healthy Homes Compliance Statement or other information. The person liable for this fine is whoever is listed on the tenancy agreement as being the person who is letting the property which could be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date when the tenancy contract is executed, and it should be maintained during the entire tenancy, as related work is completed.

It’s crucial to be aware that a landlord with multiple rental properties may receive even higher fines for non-compliance. The harshest penalties are handed down for the most serious violations. Those who have more than six properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Seaview Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is compulsory for all Seaview and New Zealand rental homes where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate compliance with each Healthy Homes Standards that apply or will apply throughout the tenancy period of their rental properties.

From 1 July 2021

  • Private landlords and property managers must make sure their rental properties comply according to Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must comply with the Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All homes let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Seaview

Draughts may lead to dropping temperatures within homes. A humid home will cost more to heat, which completed jobs in wasting energy and increased bills.

Heating Seaview

Seaview rental properties require a reliable heating source that is able to heat the largest or main living room to at least 18 degrees Celsius, even on the most coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements to remain fixed (i.e., not portable) and at least 1.5 horsepower in capacity, and meet the minimum requirement for heat capacity for the main living space. The Heating Assessment Tool can be used to determine whether the existing fix heater(s) are sufficient or whether you will require to top up with an additional heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters are not considered to be suitable heating options in The Healthy Homes Standard.

If the heating that you offer is electric heating (or heat pump), it should have the thermostat. This makes your heating more consistent and effective. For most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are required. In certain situations, such as small apartments the smaller fixed electric heater may suffice.

If the main living room is already equipped with a fixed heating source such as the heat pump, it might need an update to be able to meet the standards. Certain types of heaters cannot be used to meet the quality since they’re either expensive, inefficient and/or unsafe to run.

Ventilation Seaview

Insulation Seaview

Ceiling and underfloor insulation is a requirement on all rental houses from 1 July 2019. Property managers and landlords have to ensure the insulation meets standards that are in line with the latest standard.
