Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Seaview rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

From the 1st of July in 2021, if a new, renewed or varied Tenancy is signed for the Seaview rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to adhere to any of the Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the new, renewed or revised tenancy contract, there could be an additional penalty or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they are related to the house they are living in. If the landlord or property manager fails to provide the necessary information within 21 days from getting the notice, the tenant could receive an infringement notice and be fined up to $750.

Furthermore, there’s also a fine of as much as $900 for landlords or property managers who offer a false or false Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is listed on the tenancy agreement as being the person who is letting the property and it could be the name of the landlord, or the property management company.

All information in the Statement of Compliance needs to be current when the tenancy agreement is executed, and it should be maintained throughout the tenancy as any necessary work related to it’s finished.

It’s also important to remember that landlords who own multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are handed down for the most serious breaches, and landlords with more than six properties could be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Seaview Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement throughout Seaview and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records that demonstrate compliance with each Healthy Homes Standard that apply or will be in force during the tenure of their rental properties.

Starting 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied lease.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered Boarding home tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All households let from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Heating Seaview

Seaview rental properties need to have a stable source of heating which can warm the principal or the biggest living space to a minimum of 18degC even on the most coldest days of the year. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source requirements for it to be permanent (i.e., not portable) that is, at least 1.5 Kilowatts in heating capacity, and meet the minimum capacity for heating required for the main living space. For the majority of homes, bigger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in some cases like apartments with small spaces an electric, fixed heater may suffice.

If the living area already has a permanent heating source, like the heat pump, it might just require an upgrade in order to comply with the standards. Certain kinds of heaters cannot be used to achieve the quality because they’re costly, not cost-effective to run, and/or unhealthy to run.

Ventilation Seaview

Insulation Seaview

The insulation of the ceiling and underfloor is required in all rental homes since 1 July 2019. Property managers and landlords should make sure the insulation meets the new quality. In some instances, existing ceiling insulation or insulation in the sub floor space may require to be replaced or replaced.
