Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed on a Normandale rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.

From the 1st of July in 2021, when a new or renewed lease is entered into on a Normandale rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to meet one of the Healthy Homes Standards inside of the period of time expected can lead to an amount of $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within a new, renewed or amended tenancy agreement it could result in an additional fine or infringement fee.

Every tenant is entitled to request details regarding the Healthy Homes Standard and how they are related to the house they live in. If the property manager fails to provide the information requested within 21 days of receiving the request, they will receive an infringement letter and be fined up to $750.

Additionally, there is also a penalty up to $900 for landlords and property managers providing a false or misleading Healthy Homes Compliance Statement or information. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as being the person renting the property, so it could be the name of the landlord, or the property management company.

The information contained in the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is signed, and ideally it is updated through the tenancy period as relevant work gets completed.

It is also important to keep in mind that a landlord with multiple rental properties may face additional fines for non-compliance. The harshest penalties are given for serious violations. Those who have six or more properties can be fined as high as $50,000, or as high as $100,000 in hearings.

In the end, a failure to adhere to the Healthy Homes requirements can hit your pocket with huge fines, in addition to continuing to be required to comply with the requirements. Don’t put your rental at risk. property Contact us now and request an house assessment performed on your rental property.

Healthy homes matter

Why is Healthy Homes Compliance important?

About 1 in 3 households rent from New Zealand and Normandale, and research has shown that these rental homes are more likely to be older, colder, have less effective heating and have lower quality than the houses of owners.

Moldy, damp and cold homes are associated with negative well-being outcomes, particularly for illnesses like colds, asthma, as well as cardiovascular conditions. Furthermore, people who reported at least four key house quality problems often experience lower levels of satisfaction with life and a decrease in mental health.

Enhancing the standard of Normandale rental property will allow tenants to enjoy improved mental and physical health and reduce the disruptions to their work, education and living due to diseases. Your investment will be safeguarded from mildew, mould and damp damage, meaning less maintenance costs in the long run.

The Healthy Homes Standards are a list of specific and minimum requirements for heating, insulation, Ventilation, Moisture Ingress and Drainage, as well Draught-stopping within Normandale rental properties.

Unreasonable Gaps & Holes

Draught Stopping Normandale

Draughts increase the likelihood of less temperature in households. A draughty home is more expensive to heat, meaning wasting money and energy.

If a draught could be noticed from gaps that are not adequate or holes, it needs to be closed.

What are unjustifiable gaps or holes?

If you can feel external air getting in, or see an unobstructed draught coming from a crack or a gap or crack, then it’s most likely a gap or an opening that needs sealing in any way. Cracks or gaps with large gaps must be stopped permanently. Any gaps greater than 3mm that allow air in or out into your house need seals. For instance, if an open fireplace isn’t being used, it can cause draughts and must be sealed from. Landlords and property managers are responsible for making sure that such draughts are squelched in the maximum extent possible.

You don’t need to block holes or gaps which are part of the building. For example, tiny gaps around windows and doors could be necessary to allow for movement within the structure as the home warms and cools so that they are able to be closed and opened instead of than securing. We will check the windows and doors during an Healthy Homes assessment of your rental property.

Adequate heaters are important for healthy houses

Heating Normandale

Normandale rental properties need to have a stable source of heat that is able to heat the living space to a minimum of 18degC, even on the coldest winter days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements for it to be permanent (i.e., not portable) with at minimum 1.5 kW of heating capacity and have the minimum heating capacity needed in the living area. A Heating Assessment Tool could be used to determine whether your current permanent heater(s) are sufficient or whether you will require to "top up" with an additional heater. Unflued combustion and open fire heaters like the portable LPG bottle heaters aren’t considered to be acceptable heating options in the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump then it must include an thermostat. This will help make the heating more consistent and effective. For most homes, larger fixed heating equipment like heat pumps, wood burners pellet burners, flued gas heaters are required. However, in certain instances like small apartments an electric, fixed heater may be sufficient.

If the main living room already has a permanent heating source, like a heat pump, then it could need an update to be able to meet the standards. Certain types of heaters cannot be used to comply with the standard because they’re not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Normandale

Every living space in a rental property must include at least one open door or window to offer natural airflow. In addition, humid spaces like kitchens and bathrooms need to have an externally vented extractor fan to take moisture away.

A ventilation quality is all about recognising it is that dried air can be much easier to heat, and that a well ventilated rental property is less likely to grow mould and damp.

Bedrooms, living spaces, kitchens, and dining rooms are considered to be liveable spaces. Connecting spaces such as the hallway aren’t considered liveable and are not need an opening door or window.

Each window, door , or the skylight requirements for them to be in a position to open up to the outside while remaining closed in order to allow to circulate fresh air as well as air flow.

All bathrooms and kitchens as well as any other space in your property with a bath, shower and cooktop or another moisture generating item will need adequate extractor fans which are vented out to the outside. The Healthy Homes Assessment service will verify that there is enough ventilation throughout the living spaces with the right extractor fan in high moisture areas.

Insulation Normandale

Ceiling and underfloor insulation has been compulsory for all rent houses from 1 July 2019. Property managers and landlords must ensure that the insulation meets the new quality. In some instances, an existing insulation on the ceiling or in the subfloor space may require to be topped up or replaced.

A house that is well-insulated can help control condensation and lower the chance of mould and damp, and also makes much easier to allow the house to hold warmth.

Insulation requirements to meet the R-values that are appropriate for your region.

The "R" is a symbol for thermal resistance and is a measure of how well the insulation resists heat flow. The more high the R-value, more efficient the insulation.

Normandale Moisture Ingress & Drainage

Keeping your rental property safe from water damage isn’t only about the inside of the building it is also about the outside. You must ensure there is somewhere for rain, surface and ground water to go and also stop it from getting into the building. When it comes to moisture and damp it’s typically what you don’t see that could become a major issue that can cause the property to suffer and affecting your tenant’s well-being.

Rental properties need to have effective drainage to remove the stormwater and surface waters, and ground water. This includes an appropriate outfall or runoff. Making sure that the water has a location to go, and also that it doesn’t sit beneath buildings is a vital aspect of making sure your property is dry.

Alongside an irrigation system to stop the ingress of moisture, if your property has an enclosed space between floorboards and the ground, a ground moisture barrier must be installed if it is reasonably practicable to do so.

The ground-moisture barrier generally a polythene sheet laid over the ground, in order to block any moisture that is present in the ground from getting into the home. It also helps in preventing any damage to your underfloor insulation.
