Fines for Failing to Comply

From the 1st of July in 2021, once a new, renewed or varied tenancy is signed for a Naenae rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Beginning on July 1st, 2021, once a new, renewed or varied Tenancy is signed for the Naenae rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the expected timeframe can result in penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included in a new, renewed or amended tenancy agreement it could result in an additional fine or violation fee.

If the landlord or property manager does not provide the necessary information within 21 days from receiving the request, they could receive an infringement notification and be fined as high as $750.

Additionally, there is also a fine of approximately $900 for landlords and property managers who offer a false or incorrect Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is the person who is named on the tenancy agreement as the one who is leasing the property out which could be the name of the landlord or the property management company.

The information contained in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is completed, and should be maintained throughout the tenancy as any necessary work related to it is finished.

It’s also important to be aware that landlords with multiple rental properties could face additional fines for non-compliance. The most severe penalties are handed down only for serious breaches. Landlords with six or more properties can be penalised up to $50,000, and even as high as $100,000 in hearings.

Naenae Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory for all Naenae and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement should be included in any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records that demonstrate conformance with each Healthy Homes Standards that apply or will apply during the tenancy of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers must make sure their rental properties conform to the Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All boarding homes (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All homes which are rented to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of the time of the first day of tenancy.

However, in certain instances like small apartments an electric, fixed heater may be sufficient.
