Fines for Failing to Comply

From the 1st of July in 2021, if a new, renewed or varied tenancy is signed for a Naenae rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Since the 1st July of 2021, when a new, renewed or varied lease is entered into on the Naenae rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Inability to adhere to each of Healthy Homes Standards by the end of the expected timeframe can result in penalties of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included in the renewal, new or amended tenancy agreement there may be an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the building they reside in. If the landlord or property manager fails to provide the necessary information within 21 days of having received the inquiry, they may receive an infringement notice and be fined up to $750.

In addition, there’s also a penalty up to $900 for landlords or property managers that provide false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible to pay this fine is the one who is named on the tenancy contract as the person letting the property out It could also be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance needs to be current before the tenancy agreement can be executed, and it should be maintained during the entire tenancy, as related work is completed.

It is important to remember that landlords who own multiple rental properties could face even higher fines for non-compliance. The highest penalties are reserved for serious breaches, and landlords with six or more properties could receive fines of up to $50,000, or as high as $100,000 in hearings.

Naenae Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is mandatory throughout Naenae and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate conformance with all Healthy Homes Standards that apply or will be applicable during the tenure of your rental home.

From July 1st 2021

Unreasonable Gaps & Holes

Draughts may lead to lower temperatures in homes. A draughty house is more expensive to heat, meaning wasting energy and incurring higher costs.

If a draft can be felt through gaps that are too large or holes or holes, it needs to be sealed.

Heating Naenae

Rental properties in Naenae should have a permanent source of heat which can warm the main or largest living space to at least 18degC, even during the winter coldest days.
