Fines for Failing to Comply

Beginning on July 1st, 2021, if a new or renewed tenancy is signed for a Naenae rental property, all Healthy Homes compliance tasks need to be finished inside of 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on the Naenae rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards inside of the deadlines can result in a fine of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance isn’t included in an updated, renewed, or revised tenancy contract, there may be an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the home they reside in. If the property manager fails to supply the necessary information within 21 days from receiving the request, they can receive an infringement notification and could be fined up to $750.

In addition, there’s an additional fine of up to $900 for landlords and property managers providing a false or false Healthy Homes Compliance Statement or information. The person who is liable for this fine is the person who is named on the lease agreement as the person who is letting the property out, so it could be the landlord’s name or the company that manages the property.

The information contained in the Compliance Statement needs to be up-to-date before the tenancy agreement can be executed, and it is updated through the tenancy period as relevant work gets completed.

It’s also crucial to note that landlords who manage several rental properties can face greater penalties for non-compliance. The highest penalties are handed down for the most serious breaches, and landlords with more than six properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.

When will I require to be in compliance with requirements of the Healthy Homes Standards?

Naenae Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and the 30th June in 2021

  • Underfloor and ceiling insulation is required in all Naenae and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Property managers and landlords are required to keep records that prove conformance with the Healthy Homes Standards that apply or will be applied to their rental properties.

Beginning 1 July 2021

  • Private landlords and property managers must make sure that their rental properties are in compliance with the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must comply with the Healthy Homes Standards regardless of when the tenancy began.

Starting 1 July 2023

  • All homes which are rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the date when the tenancy started.

Large gaps and cracks should be stopped permanently. Gaps greater than 3mm that let air in or out of your house require seals. For example, if the open fireplace isn’t in use it may cause draughts and must be sealed off.
