Fines for Failing to Comply

As of 1st July 2021, when a new or renewed tenancy is signed on a Naenae rental property, all Healthy Homes compliance tasks have to be taken care of inside of 90 days.

The person liable for this fine is the person who is named on the lease contract as the person who is letting the property It could also be the name of the landlord, or the company that manages the property.

All information in the Statement of Compliance needs to be accurate at the time that the tenancy agreement is signed. It should be maintained during the entire tenancy, as relevant work gets completed.

It is also important to be aware that a landlord who have multiple rental properties could face additional fines for non-compliance. The highest penalties are handed down for serious violations, and landlords who own six or more properties can be penalised up to $50,000 and as high as $100,000 in the case of hearing claims.

Naenae Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 to 30 , June 20,21

  • Underfloor and ceiling insulation is compulsory in all Naenae and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove conformance with any Healthy Homes Standards that apply or will be applicable during the tenure of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any new, renewed , or altered Tenancy.
  • All the boarding houses (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must meet the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of the time of the first day of tenancy.

Heating Naenae

Naenae rental properties should have a permanent heating source that can heat the largest or main living area to at minimum 18degC even on the coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs for it to be permanent (i.e., not portable), at least 1.5 kW of heating capacity, and must meet the minimum requirement for heat capacity in the living area.
