Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Melling rental property, all Healthy Homes compliance tasks need to be done inside of 90 days.

From the 1st of July in 2021, when a new, renewed or varied tenancy is signed on a Melling rental property, all Healthy Homes compliance work must be completed within 90 days.

Tenancies signed between 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is a requirement for all Melling and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the conformance to each Healthy Homes Standards that apply or will be applicable during the tenure of an apartment rental.

From July 1st 2021

  • Property managers and private landlords should ensure their rental properties comply with the Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
