Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed for a Melling rental property, all Healthy Homes compliance items must be finished inside of 90 days.

Melling Healthy Homes Compliance Timeframes

Tenancies that were signed beginning on 1 July 2019 and 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory in all Melling and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate the compliance with all Healthy Homes Standard that apply or will be applied throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Private landlords and property managers are required to ensure their rental properties comply with the Healthy Homes Standards within 90 days of a renewal, new or a change in tenancy.
  • All boarder households (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2023

  • All houses which are rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental houses are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.

Draughts are a major cause of lower temperatures in houses. A damp home is more expensive to heat, resulting in wasted energy and incurring higher costs.

What are unreasonable gaps and holes?

If you are able to feel external air getting in, or see the sound of a clear draught emanating from a crack or a gap, then it’s likely a crack or hole which needs sealing in the way you can. Large cracks and gaps should be sealed permanently. Gaps greater than 3mm that allow air to enter or exit of the house need the sealing. In the case of an open fireplace isn’t being used, it could cause draughts, and should be blocked from. Property managers and landlords are accountable for ensuring such draughts are eliminated in the maximum extent possible.

You don’t require to block off holes or gaps which are part of the building. Adequate heaters are important to ensure healthy homes

Heating Melling

Rental properties in Melling must have a fixed source of heating which can warm the living space to a minimum of 18degC, even on the winter coldest days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental well-being.

However, in certain instances such as small apartments an electric, fixed heater could be enough.

If your living space already has a permanent heating source, like heat pumps, it might require a top up in order to comply with the standards. Certain types of heaters cannot be used to achieve the standard since they’re either not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Melling
