Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Maungaraki rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

Beginning on July 1st, 2021, if a new, renewed or varied contract is signed on the Maungaraki rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy contract, it could result in an additional fine or violation fee.

Any tenant may request information about the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager does not supply the necessary information within 21 days of receiving the request, they may receive an infringement notification and could be fined up to $750.

In addition, there is also a fine of up to $900 for landlords and property managers who provide a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person liable for this fine is the person who is named on the tenancy agreement as being the person renting the property and it could be the landlord’s name or the company that manages the property.

All the information on the Statement of Compliance needs to be accurate when the tenancy agreement is executed, and it should be kept updated during the entire tenancy, as necessary work related to it is finished.

It’s crucial to note that landlords who manage multiple rental properties may receive additional fines for non-compliance. The harshest penalties are reserved for the most serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Maungaraki Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement to all Maungaraki and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included in any renewal, new or amended tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the compliance with the Healthy Homes Standards that apply or will be in force during the tenure of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties comply to the Healthy Homes Standards within 90 days of any renewal, new or a change in tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

Beginning 1 July 2023

  • All houses that are rented out by Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of when the tenancy began.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or an unobstructed draught coming from a crack or a gap, then it’s likely to be a gap or hole which needs sealing in somehow. Large gaps and cracks should be sealed permanently. Any gaps greater than 3mm that allow air to enter or exit within your home require to be sealed. For example, if the open fireplace is not in use, it can create draughts. This should be sealed off. Landlords and property managers are responsible for making sure such draughts are eliminated as far as imaginable.

Rental properties in Maungaraki should have a permanent source of heating that can heat the living space to a minimum of 18degC, even during the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

Property managers and landlords should make sure that the insulation meets standards that are in line with the latest standard.
