Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed for a Maungaraki rental property, all Healthy Homes compliance work need to be completed by the end of 90 days.

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed on the Maungaraki rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Inability to adhere to any of the Healthy Homes Standards by the end of the deadlines can result in the possibility of a fine up to $7200. Additionally, if the most current Healthy Homes Statement of Compliance isn’t included in the renewal, new or amended tenancy agreement there could be an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or the property manager doesn’t provide the necessary information within 21 days of getting the notice, the tenant could receive an infringement notification and be fined upto $750.

Furthermore, there’s also a penalty approximately $900 for landlords or property managers who have provided a false or false Healthy Homes Compliance Statement or information. The person responsible for this fine is the person who is listed on the tenancy agreement as the person who is who is letting the property It could also be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement needs to be correct at the time that the tenancy agreement is executed, and it should be kept updated throughout the duration of the tenancy when any associated work has been completed.

It’s also important to note that landlords who have multiple rental properties could face even higher fines for non-compliance. The harshest penalties are reserved for the most serious violations, and landlords who own at least six rental properties could be penalised up to $50,000 and as high as $100,000 in hearing claims.

Maungaraki Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • Ceiling and underfloor insulation is mandatory throughout Maungaraki and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply, an Insulation Statement and an Insurance Statement must be included with any renewed, new or amended tenancy agreement.
  • Property managers and landlords have to keep records to demonstrate compliance with each Healthy Homes Standards that apply or will be applied during the tenancy of an apartment rental.

From 1 July 2021

  • Private landlords and property managers have to ensure their rental properties conform to the Healthy Homes Standard within 90 days of any new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All homes rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.

You don’t need to block up intentional holes or gaps in the building. For example, tiny gaps around windows and doors may be required to allow movement of the structure when the household warms and cools so that they can still be closed and opened rather than securing. Heating Maungaraki

Rental properties in Maungaraki should have a permanent heating source that can warm the principal or the biggest living room to at least 18degC, even during the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

All landlords and property managers have to make sure the insulation meets standards that are in line with the latest quality.
