Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed for a Manor Park rental property, all Healthy Homes compliance items must be completed within 90 days.

If the landlord or the property manager doesn’t supply the information requested within 21 days from having received the inquiry, they could receive an infringement letter and be fined upto $750.

Furthermore, there’s also a fine of as much as $900 for landlords and property managers that provide false or false Healthy Homes Compliance Statement or other information. The person who is liable to pay this fine is the one who is named on the lease agreement as the person who is renting the property, so it could be the name of the landlord as well as the company that manages the property.

All information in the Compliance Statement needs to be accurate at the time that the tenancy agreement is completed, and must be updated during the entire tenancy, as necessary work related to it’s finished.

It’s also crucial to note that landlords who own several rental properties can face even higher fines for non-compliance. The highest penalties are reserved for the most serious breaches, and landlords with six or more properties can receive fines of up to $50,000, or as high as $100,000 in hearing claims.

Manor Park Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required to all Manor Park and New Zealand rental houses where it’s reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Property managers and landlords must keep records to demonstrate conformance with the Healthy Homes Standard that apply or will apply to an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform to the Healthy Homes Standards within 90 days of any newly renewed, extended or changed tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) are required to comply with Healthy Homes Standard regardless of when the tenancy began.

Beginning 1 July 2023

  • All homes rented from Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.
