Fines for Failing to Comply
As of 1st July 2021, when a new, renewed or varied tenancy is signed on a Homedale rental property, all Healthy Homes compliance items have to be taken care of by the end of 90 days.
Beginning on July 1st, 2021, when a new or renewed contract is signed on the Homedale rental property, all Healthy Homes compliance work must be finished within 90 days.
Failure to adhere to each of Healthy Homes Standards inside of the deadlines can result in penalties of up to $7200. Furthermore, if a present Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement, it could result in an additional fine or infringement fee.
Any tenant may request information about the Healthy Homes Standard and how they relate to the property they reside in. If the property manager is unable to provide the necessary information within 21 days from receiving the request, they may be issued an infringement notice and be fined upto $750.
Furthermore, there’s also a fine of approximately $900 for property owners or property managers who have provided a false or false Healthy Homes Compliance Statement or any other information. The person responsible to pay this fine is the one who is listed on the tenancy agreement as being the person leasing the property out, so it could be the landlord’s name or the property management company.
All the information on the Statement of Compliance needs to be up-to-date before the tenancy agreement can be signed. It should be kept updated throughout the tenancy as any associated work has been completed.
It is important to remember that landlords with several rental properties can face more severe penalties for not complying. The harshest penalties are handed down only for serious violations. Those who have more than six properties could receive fines of up to $50,000, and even as high as $100,000 in hearings.
