Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied contract is signed on a Homedale rental property, all Healthy Homes compliance tasks must be finished inside of 90 days.

From the 1st of July in 2021, when a brand new, renewed or varied Tenancy is signed for the Homedale rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the period of time expected can lead to penalties of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or amended tenancy agreement there may be an additional fine or infringement fee.

Any tenant can ask for information regarding the Healthy Homes Standard and how they relate to the building they live in. If the landlord or the property manager doesn’t supply the information requested within 21 days from having received the inquiry, they can receive an infringement notice and be fined upto $750.

In addition, there’s an additional fine of up to $900 for property owners or property managers providing a false or inaccurate Healthy Homes Compliance Statement or information. The person responsible to pay this fine is the one who is listed on the tenancy agreement as being the person leasing the property out and it could be the name of the landlord or the property management company.

The information contained in the Compliance Statement needs to be up-to-date when the tenancy agreement is executed, and it should be kept updated during the entire tenancy, as necessary work related to it’s finished.

It is crucial to remember that landlords who manage multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved only for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 for hearing claims.

Homedale Healthy Homes Compliance Timeframes

Tenancies established beginning on 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is required throughout Homedale and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement must be included with any renewed, new or modified tenancy agreement.
  • Property managers and landlords must keep records to demonstrate compliance with all Healthy Homes Standard that apply or will be applicable to the rental property.

From July 1st 2021

  • Private landlords and property managers should ensure their rental properties conform in accordance with Healthy Homes Standards within 90 days of any renewal, new or a change in tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarding home tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

Starting 1 July 2023

  • All houses let from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental homes must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Heating Homedale

Homedale rental properties must have a fixed source of heating that is able to heat the principal or the biggest living room to at least 18 degrees Celsius, even on the winter coldest days. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being as well as their mental health.

However, in certain instances like small apartment buildings small apartments, a smaller electric fixed heater could be enough.

If your living space already has a central heating source such as a heat pump, then it could require an upgrade to make sure it meets the requirements. Certain kinds of heaters aren’t able to be used to meet the quality as they are either inefficient, unaffordable to operate or unsafe to operate.

Ventilation Homedale

The insulation of the ceiling and underfloor has been compulsory for all rent homes as of July 1st, 2019. All landlords and property managers have to ensure that the insulation meets the new standard. In some cases, existing ceiling insulation or insulation in the subfloor space may require to be replaced or replaced.
