Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Homedale rental property, all Healthy Homes compliance tasks have to be taken care of within 90 days.

Additionally, there is also a penalty of approximately $900 for landlords and property managers who offer a false or inaccurate Healthy Homes Compliance Statement or information. The person responsible for this fine is the person who is named on the tenancy agreement as being the person leasing the property out which could be the name of the landlord or the property management company.

All information in the Compliance Statement needs to be up-to-date at the time that the tenancy agreement is executed, and it should be maintained during the entire tenancy, as necessary work related to it is finished.

It is also important to be aware that landlords with several rental properties can face additional fines for non-compliance. The highest penalties are given only for serious breaches, and landlords with more than six properties could receive fines of up to $50,000, or as high as $100,000 in hearings.

Tenancies commenced from 1 July 2019 to the 30th June in 2021

  • Insulation of the underfloor and ceiling is a requirement throughout Homedale and New Zealand rental houses where it’s reasonably practicable to install.
