Fines for Failing to Comply

Beginning on July 1st, 2021, once a new, renewed or varied tenancy is signed on a Homedale rental property, all Healthy Homes compliance work have to be completed within 90 days.

From the 1st of July in 2021, when a new, renewed or varied contract is signed on a Homedale rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to adhere to any of the Healthy Homes Standards within the deadlines can result in a fine of up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the property they live in. If the property manager fails to supply the information requested within 21 days of getting the notice, the tenant will receive an infringement notice and be fined upto $750.

Additionally, there is also a penalty up to $900 for property owners or property managers that provide false or false Healthy Homes Compliance Statement or information. The person responsible for this fine is the one who is listed on the tenancy agreement as being the person renting the property, so it could be the landlord’s name or the company that manages the property.

All the information on the Statement of Compliance needs to be accurate when the tenancy contract is completed, and should be kept updated throughout the tenancy as any associated work has been completed.

It’s important to remember that a landlord who have multiple rental properties may receive greater penalties for non-compliance. The harshest penalties are reserved only for serious breaches, and landlords with more than six properties could be penalised up to $50,000, and even as high as $100,000 in hearings.

Tenancies signed in the period between July 1st 2019 to 30 June 2021

  • Ceiling and underfloor insulation is a requirement for all Homedale and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included with any new, renewed or modified tenancy agreement.
  • Landlords and property managers must keep records that demonstrate conformance with the Healthy Homes Standard that apply or will be applicable throughout the tenancy period of the rental property.

From July 1st 2021

  • Private landlords and property managers should ensure that their rental properties are in compliance in accordance with Healthy Homes Standards within 90 days of a new, renewed or varied tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider for boarding home tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

For instance, if an open fireplace isn’t being used, it can cause draughts and should be blocked from. Property managers and landlords are responsible for ensuring that these draughts are stopped in the maximum extent possible.

You don’t require to block up intentional gaps or holes in the building. For example, tiny gaps around windows and doors may be required to allow for movement of the structure when the house is heated and cools so that they are able to be opened and closed rather than sticking. Heating Homedale

Rental properties in Homedale must have a fixed source of heating which can warm the principal or the biggest living space to at least 18degC even on the coldest winter days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical health and mental outlook.

In certain situations, like small apartments the smaller fixed electric heater may be sufficient.

If the living area already has a fixed heating source, like an air conditioner, it may require an upgrade to make sure it meets the requirements. Certain types of heaters cannot be used to comply with the quality since they’re either inefficient, unaffordable to operate or are unsafe to operate.
