Fines for Failing to Comply

As of 1st July 2021, if a new or renewed contract is signed on a Haywards rental property, all Healthy Homes compliance tasks have to be done inside of 90 days.

Tenancies that were signed in the period between July 1st 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement to all Haywards and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records of their the compliance with all Healthy Homes Standards that apply or will be applied to their rental properties.

From 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply in accordance with Healthy Homes Standard within 90 days of any new, renewed , or altered Tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarding household tenancies) must adhere to the Healthy Homes Standard regardless of the time the tenancy began.

From 1 July 2023

  • All homes let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rental houses are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Heating Haywards

Rental properties in Haywards need to have a stable source of heating which can warm the principal or the biggest living space to at least 18degC, even on the winter coldest days. This is the minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heating needs to remain fixed (i.e., not portable) and at least 1.5 kW in heating capacity, and must meet the minimum required heating capacity for the main living space. For most homes, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are necessary. However, in some cases like apartments with small spaces small apartments, a smaller electric fixed heater may suffice.

If the main living room already has a permanent heating source, like a heat pump, then it could require some additional energy to meet the standards. Certain types of heaters cannot be used to meet the standard since they’re either not effective, cost prohibitive to operate or are unsafe to operate.
