Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Haywards rental property, all Healthy Homes compliance items must be done within 90 days.

As of 1st July 2021, once a new or renewed Tenancy is signed for the Haywards rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the deadlines can result in an amount of $7200. In addition, if the current Healthy Homes Statement of Compliance is not included in a new, renewed or amended tenancy agreement there could be an additional penalty or infringement fee.

Every tenant is entitled to request information about the Healthy Homes Standard and how they are related to the house they live in. If the property manager fails to supply the required information within 21 days from receiving the request, they could be issued an infringement notice and be fined up to $750.

Additionally, there is also a fine of as much as $900 for property owners or property managers providing a false or false Healthy Homes Compliance Statement or any other information. The person who is liable for this fine is the person who is listed on the tenancy contract as the person leasing the property out It could also be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be up-to-date when the tenancy agreement is signed, and ideally it is updated through the tenancy period as necessary work related to it’s finished.

It is also important to remember that landlords who own multiple rental properties could face even higher fines for non-compliance. The harshest penalties are handed down only for serious violations, and landlords who own six or more properties could be fined up to $50,000, and as much as $100,000 in hearing claims.

Haywards Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 and 30 , June 20,21

  • Insulation of the underfloor and ceiling is required throughout Haywards and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove the compliance with any Healthy Homes Standard that apply or will be applied to your rental home.

From July 1st 2021

  • Property managers and private landlords should make sure their rental properties comply with the Healthy Homes Standard within 90 days of a new, renewed or varied tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarder house tenancies) must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2023

  • All households let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Haywards

Draughts are a major cause of low temperatures inside houses. A damp house is more expensive to heat, which results in wasting energy and resulting in higher bills.

If a draught could be perceived as a result of gaps or holes the area needs to be sealed.

What are unreasonable gaps and holes?

If you are able to feel external air getting in, or see the air is clear from a crack or a gap or crack, then it is most likely a gap or hole that needs sealing in somehow. Large cracks and gaps should be stopped permanently. The gaps that exceed 3mm that allow air to enter or exit within the house need to be sealed. In the case of an open fireplace isn’t used it can cause draughts and must be sealed off. Landlords and property managers are responsible for making sure that such draughts are squelched in the maximum extent possible.

There is no require to block off gaps or holes which are part of the building. Heating Haywards

Haywards rental properties need to have a stable source of heating that can heat the living space to a minimum of 18 degrees Celsius, even on the most coldest days of the year. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source requirements to remain fixed (i.e. not portable), at least 1.5 kW of heating capacity, and it must have the minimum capacity for heating required for the main living space. Insulation Haywards

Insulation for underfloor and ceilings is required in all rental houses since July 1, 2019. All landlords and property managers must make sure that the insulation is in line with the new standard. In certain situations, the existing ceiling insulation or insulation in the subfloor space may need to be added or replaced.

A well-insulated house will reduce the risk of condensation, and decrease the risk of mould and dampness and will also make it easier to allow the home to retain the heat.
