Fines for Failing to Comply
Beginning on July 1st, 2021, once a new or renewed contract is signed on a Harbour View rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.
As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Harbour View rental property, all Healthy Homes compliance work must be taken care of within 90 days.
Failure to comply with each of Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. In addition, if the existing Healthy Homes Statement of Compliance is not incorporated in a new, renewed or revised tenancy contract, it could result in an additional penalty or infringement fee.
Every tenant is entitled to request information about the Healthy Homes Standard and how they relate to the building they live in. If the property manager fails to provide the necessary information within 21 days from being informed of the request, they may receive an infringement letter and be fined up to $750.
Furthermore, there’s also a penalty as much as $900 for landlords and property managers who have provided a false or false Healthy Homes Compliance Statement or information. The person responsible for this fine is whoever is named on the tenancy agreement as the one who is who is letting the property and it could be the name of the landlord as well as the company that manages the property.
All information in the Statement of Compliance needs to be correct when the tenancy agreement is executed, and it must be updated throughout the duration of the tenancy when any necessary work related to it’s finished.
It’s important to keep in mind that a landlord who manage multiple rental properties could face even higher fines for non-compliance. The harshest penalties are reserved for serious violations, and landlords who own six or more properties could be penalised up to $50,000 and as high as $100,000 for hearing claims.
