Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed contract is signed on a Fairfield rental property, all Healthy Homes compliance tasks need to be done within 90 days.

The person responsible for this fine is the person who is listed on the tenancy contract as the person letting the property out, so it could be the name of the landlord, or the property management company.

All the information on the Compliance Statement needs to be correct at the time that the tenancy agreement is executed, and it is updated throughout the duration of the tenancy when any relevant work gets completed.

It is also crucial to keep in mind that a landlord who have several rental properties can face more severe penalties for not complying. The highest penalties are given for severe breaches. Landlords with more than six properties could receive fines of up to $50,000 and as high as $100,000 in hearing claims.

Tenancies established in the period between July 1st 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is a requirement in all Fairfield and New Zealand rental homes where it is reasonably practicable to put in.
