Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied tenancy is signed on a Fairfield rental property, all Healthy Homes compliance items have to be finished inside of 90 days.

As of 1st July 2021, if a new, renewed or varied lease is entered into on a Fairfield rental property, all Healthy Homes compliance work must be completed within 90 days.

Failure to adhere to all of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. In addition, if the current Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy agreement, it could result in an additional fine or infringement fee.

Every tenant is entitled to request details about the Healthy Homes Standard and how they relate to the building they live in. If the the property manager doesn’t supply the information requested within 21 days of getting the notice, the tenant may receive an infringement notification and be fined upto $750.

Furthermore, there’s an additional fine of up to $900 for landlords or property managers who have provided a false or incorrect Healthy Homes Statement of Compliance or other information. The person liable to pay this fine is the one who is identified on the tenancy agreement as being the person leasing the property out, so it could be the landlord’s name or the property management company.

The information contained in the Compliance Statement needs to be current at the time that the tenancy agreement is signed, and ideally it is updated throughout the duration of the tenancy when any associated work has been completed.

It’s also crucial to be aware that landlords who own multiple rental properties could face additional fines for non-compliance. The harshest penalties are reserved only for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000 and as high as $100,000 in hearings.

Clearly, failure to adhere to your Healthy Homes requirements can hit your wallet and result in massive fines as well as having to continue to comply. Do not risk your rental property call us now and ask us to conduct an home assessment performed for your rental property.

Healthy homes are important

Why is Healthy Homes Compliance so important?

About 1 in 3 households rent from New Zealand and Fairfield, and research has shown that these rental houses tend to be colder, older and have less effective heating, and generally have lower standard than those owned by owners.

The damp, cold and mouldy homes are linked to negative well-being results, specifically for illnesses like colds, influenza, asthma, and cardiovascular conditions. Additionally, those who experience four or more major home quality issues often suffer from lower levels of satisfaction with life and a decrease in mental health.

Improving the quality of Fairfield rental property can allow tenants to experience better physical and mental health as well as lessen disruption to work, learning and daily life because of health issues. Your investment is also safeguarded from mildew, mould and damp-related damage, which results in less costs of maintenance over the long term.

The Healthy Homes Standards are a listing of minimum and specific standards for Heating, Insulation Ventilation, Moisture Ingress and Drainage, as well as Draught Stopping on Fairfield rental properties.

Unreasonable Gaps & Holes

Draught Stopping Fairfield

Draughts may lead to dropping temperatures within homes. A damp house costs more to heat, which results in wasting money and energy.

If a draught is felt through gaps that are too large or holes that it needs to be sealed.

What are the most unreasonable gaps or holes?

If you are able to feel external air entering or the sound of a clear draught emanating from a gap or hole that is, it’s likely a crack or an opening that requirements sealing in somehow. Large cracks and gaps should be stopped permanently. Gaps greater than 3mm that let air in or out from your house need to be sealed. For instance, if an open fireplace is not in use, it can create draughts. This should be shut from. Landlords and property managers are accountable for ensuring such draughts are eliminated in the maximum extent imaginable.

There is no need to block off gaps or holes which are part of the construction. For example, tiny gaps around doors and windows could be required to allow for the movement of the building as the home gets warmer and cooler, to allow them to be shut and opened, rather than sticking. We will inspect all doors and windows during the Healthy Homes assessment of your rental property.

The proper heating equipment is crucial to ensure well-being houses

Heating Fairfield

Fairfield rental properties should have a permanent heating source that can warm the principal or the biggest living area to at minimum 18degC, even on the most coldest days of the year. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health as well as their mental health.

The source of heat needs to be fixed (i.e., not portable) and at minimum 1.5 horsepower in capacity, and meet the minimum capacity for heating required for the main living space. A Heating Assessment Tool could be used to determine whether your current fix heater(s) are adequate or if you’ll require to "top up" with an additional heater. Fires that are open and unflued heaters such as portable LPG bottle heaters aren’t considered to be suitable heating options under those following the Healthy Homes Standard.

If the heating that you offer is electric heating (or heat pump), it should have an thermostat. This makes the heating more reliable and effective. In most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, like small apartments an electric, fixed heater might be enough.

If the main living room already has a central heating source, like the heat pump, it may need an update to be able to meet the standards. Certain kinds of heaters aren’t able to be used to achieve the quality as they are either not efficient, cost prohibitive to operate and/or unsafe to run.

Ventilation Fairfield

Each living space within a rental property must include at least one open window or exterior door to offer natural airflow. Additionally, areas with high moisture areas like kitchens and bathrooms must have a suitable externally vented extractor fan that can remove moisture.

It is the ventilation standard is about recognising the fact that dry air will be much easier to heat and a property that is well ventilated will be less prone to developing mould and damp.

Living rooms, bedrooms, kitchens, and dining rooms are considered liveable areas. Connecting spaces such as the hallway aren’t liveable , and thus are not require an opening window or door.

Each door, window or skylight needs for them to be in a position to open up to the outside, and stay set in an opening position, allowing for fresh air circulation and ventilation.

All kitchens and bathrooms, and any other area in your house that houses shower, bath or cooktop, or any other moisture generating item will require proper extractor fan systems that can be vented to the outdoors. This Healthy Homes Assessment service will ensure that there is sufficient air circulation in every living space that includes extractor fans that are suitable in areas with high moisture.

Insulation Fairfield

The insulation of the ceiling and underfloor has been compulsory in all rental houses from 1 July 2019. All landlords and property managers must make sure that the insulation meets the new quality. In some instances, existing ceiling insulation or insulation in the subfloor space might need to be topped up or replaced.

A house that is well-insulated can reduce condensation, and decrease the risk of mould and dampness, and will also make it easier to the home to hold warmth.

Insulation requirements to be in compliance with the R-values for your area

The "R" signifies thermal resistance and is a gauge of how well the insulation is able to resist heat flow. The more R-value is higher, the higher the quality of insulation.

  • Zone 1 Zone 1 Auckland & Northland - ceiling R 2.9, underfloor R 1.3
  • Zone 2 – The rest of the North Island except Taupo and the Central Plateau – ceiling R 2.9 and underfloor R 1.3
  • Zone 3 Zone 3 North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 and underfloor R 1.3

Fairfield Moisture Ingress & Drainage

Making sure your rental property is protected from water damage isn’t only about the inside but you must ensure there is somewhere for surface and ground water to go, and to prevent it from getting inside. When it concerns damp and moisture it’s typically the concerns you don’t notice that can become a big problem and end up causing the property to suffer and affecting the tenant’s health.

Rental properties need to be equipped with effective drainage to get rid of floodwaters, surface water, and groundwater, with an appropriate outfall or runoff. Making sure the water is able to go, and also that it can’t linger underneath the buildings is a vital aspect of keeping your property dry.

Alongside a drainage system to avoid moisture from entering, if your apartment has an enclosed gap between your flooring and the soil, a ground-water barrier must be installed if it is reasonably practicable to install it.

The ground-moisture barrier typically made of polythene and is laid on top of the ground, to block any moisture in the ground from rising into the property. It also helps to prevent any damage to your underfloor insulation.
