Fines for Failing to Comply

Since the 1st July of 2021, if a new or renewed tenancy is signed on a Fairfield rental property, all Healthy Homes compliance items must be completed by the end of 90 days.

Since the 1st July of 2021, once a new or renewed tenancy is signed on the Fairfield rental property, all Healthy Homes compliance work must be done inside of 90 days.

Failure to meet any of the Healthy Homes Standards by the end of the period of time expected can lead to the possibility of a fine up to $7200. Furthermore, if a current Healthy Homes Statement of Compliance is not included in the renewal, new or revised tenancy contract, there could be an additional fine or infringement fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the property they reside in. If the the property manager doesn’t provide the information requested within 21 days from getting the notice, the tenant will receive an infringement notice and be fined up to $750.

In addition, there is also a penalty of approximately $900 for property owners or property managers who have provided a false or incorrect Healthy Homes Compliance Statement or any other information. The person who is responsible for this fine is whoever is identified on the tenancy agreement as being the person renting the property, so it could be the name of the landlord or the property management company.

All the information on the Statement of Compliance needs to be up-to-date when the tenancy contract is executed, and it must be updated through the tenancy period as necessary work related to it’s finished.

It is important to remember that landlords who own multiple rental properties may receive additional fines for non-compliance. The most severe penalties are given for serious breaches. Landlords with more than six properties could be penalised up to $50,000, or as high as $100,000 in hearings.

When do I require to be in compliance with my Healthy Homes Standards?

Fairfield Healthy Homes Compliance Timeframes

Tenancies that were signed in the period between July 1st 2019 to the 30th June in 2021

  • Ceiling and underfloor insulation is mandatory throughout Fairfield and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records of their compliance with each Healthy Homes Standard that apply or will be applied to your rental home.

Starting 1 July 2021

  • Property managers and private landlords must ensure their rental properties comply according to Healthy Homes Standard within 90 days of any new, renewed , or altered tenant.
  • All the boarding houses (except Kainga Ora and Community Housing Providers with registered for boarding house tenancies) are required to comply with Healthy Homes Standard regardless of the time the tenancy began.

From July 1st 2023

  • All households that are rented out by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Unflued combustion and open fire heaters like the portable LPG bottle heaters aren’t considered to be acceptable heating options under those following the Healthy Homes Standard.

If the heating system you provide is an electric heater or heat source, it must be equipped with an thermostat. This will make the heating more consistent and effective. In most homes, larger fixed heating systems such as heat pumps, wood burners, pellet burners or flued gas heaters are needed. However, in some cases such as small apartments an electric, fixed heater could be enough.
