Fines for Failing to Comply

As of 1st July 2021, when a brand new, renewed or varied contract is signed on a Fairfield rental property, all Healthy Homes compliance items need to be completed by the end of 90 days.

From the 1st of July in 2021, if a new or renewed Tenancy is signed for the Fairfield rental property, all Healthy Homes compliance work must be done within 90 days.

Failure to comply with one of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Fairfield Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is compulsory for all Fairfield and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or amended tenancy agreement.

Heating Fairfield

Rental properties in Fairfield require a reliable source of heat that is able to heat the principal or the biggest living room to at least 18degC, even during the winter coldest days. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source requirements that it be permanently fixed (i.e. not portable) and at minimum 1.5 horsepower in capacity, and it must have the minimum capacity for heating required for the main living room. If your living space already has a fixed heating source, like a heat pump, then it might just require some additional energy in order to comply with the standards. Certain kinds of heaters cannot be used to meet the standard as they are either costly, not affordable to run, and/or unsafe to run.

Ventilation Fairfield

Each liveable space in a rental house must have at least one opening window or exterior door to offer natural airflow. In addition, high moisture areas like kitchens and bathrooms need to have an venting fan outside to remove moisture.
