Healthy Homes Assessment Services

Did you be aware that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords must ensure that their Epuni rental properties meet the minimum Healthy Homes Standards within 90 days of any new or renewed tenancy and all private rentals must be fully conforming by the 1st July 2024.

Inability to meet the standards under the Healthy Homes Standards is a violation in the Residential Tenancies Act 1986, and any landlord found not following the rules could be subject to fines of up to $7200 plus any additional healthy homes connected fines.

Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed on an Epuni rental property, all Healthy Homes compliance work must be completed within 90 days.

Beginning on July 1st, 2021, if a new or renewed contract is signed on the Epuni rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to comply with all of the Healthy Homes Standards within the expected timeframe can result in a fine of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement there may be an additional penalty or infringement fee.

Any tenant may request details regarding the Healthy Homes Standard and how they relate to the home they reside in. If the landlord or the property manager doesn’t provide the information requested within 21 days from receiving the request, they will receive an infringement notice and be fined up to $750.

In addition, there’s also a penalty as much as $900 for property owners or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is liable to pay this fine is the one who is named on the tenancy contract as the person leasing the property out and it could be the name of the landlord or the company that manages the property.

All the information on the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is signed, and ideally it should be kept updated through the tenancy period as associated work has been completed.

It’s also important to note that landlords who have multiple rental properties may face additional fines for non-compliance. The highest penalties are given for the most serious violations. Those who have six or more properties can be penalised up to $50,000, and as much as $100,000 in hearings.

When do I require to be in compliance with the Healthy Homes Standards?

Epuni Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 and the 30th June in 2021

  • Ceiling and underfloor insulation is a requirement for all Epuni and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement should be included in any renewed, new or varied tenancy agreement.
  • Landlords and property managers must keep records of their the compliance with each Healthy Homes Standards that apply or will apply during the tenancy of the rental property.

Beginning 1 July 2021

  • Private landlords and property managers have to ensure their rental properties conform with the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenant.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From July 1st 2023

  • All houses that are rented out through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2024

  • All rental houses must comply with the Healthy Homes Standard regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Epuni

Draughts may lead to less temperature in homes. A cold house costs more to heat, which results in wasting energy and resulting in higher bills.

If a draft can be noticed from gaps that are not adequate or holes the area needs to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a gap or hole, then it is probably a gap or crack that requirements sealing in somehow. Cracks and gaps that are large should be fixed permanently. The gaps that exceed 3mm that let air in or out within your house need the sealing. For example, if an open fireplace isn’t used it can cause draughts and should be shut from. Property managers and landlords are responsible for making sure that draughts from the fireplace are removed whenever imaginable.

You don’t need to cover up holes or gaps which are part of the building. For instance, small gaps around windows and doors could be necessary to allow for movement of the building when the home warms and cools in order to let them be shut and opened, rather instead of being stuck. A good heating system is important for healthy homes

Heating Epuni

Epuni rental properties need to have a stable source of heat which can warm the main or largest living space to at least 18 degrees Celsius, even on the winter coldest days. This is the minimum indoor temperature recommended by the World Health Organisation for people’s physical health and mental well-being.

The heating source needs that it be permanently fixed (i.e. not portable) that is, at least 1.5 kW in heating capacity, and it must have the minimum capacity for heating required for the main living space. The Heating Assessment Tool can be used to determine whether the existing installed heater(s) are sufficient or if you’ll need to "top-up" with a new heater. Unflued combustion and open fire heaters, such as portable LPG bottle heaters aren’t considered acceptable heating options for the Healthy Homes Standard.

If the heating you offer is electric heating (or heat pump), then it must have an thermostat. This will help make your heating more consistent and efficient. In most houses, larger heaters that are fixed, such as wood burners, heat pumps, pellet burners or flued gas heaters are necessary. However, in some cases such as small apartments small apartments, a smaller electric fixed heater could be enough.

If the living area already has a permanent heating source, like the heat pump, it might need an update to meet the standards. Certain kinds of heaters cannot be used to meet the quality as they are either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Epuni

Each living space within the rental property should have at least one opening window or exterior door to provide natural airflow. In addition, humid areas such as kitchens or bathrooms should have an externally vented extractor to eliminate moisture.

This ventilation quality is all about understanding how dry air is easier to heat and that an apartment that is well-ventilated is less likely to develop mould and damp.

Bedrooms, living spaces, kitchens and dining rooms are considered liveable spaces. Connecting spaces like the hallway aren’t considered living spaces and therefore are not require an opening door or window.

Each window, door , or the skylight requirements at least to open up to the outside, and stay at an open angle in order to allow ventilation and fresh air air flow.

All kitchens and bathrooms, and every other room of your home with shower, bath, cooktop or other high moisture-producing item will require adequate extractor fans which are vented out to the outside. Insulation Epuni

Ceiling and underfloor insulation is mandatory for all rent homes since 1 July 2019. Property managers and landlords have to make sure that the insulation is up to standards that are in line with the latest standard. In some cases, current ceiling insulation, or the insulation of the sub floor space may need to be topped up or replaced.

A properly insulated home will reduce the risk of condensation and reduce the chances of mould and damp, and also makes more easy to the house to keep warmth.

Insulation needs to be in compliance with the R-values that are appropriate for your region.

The "R" signifies thermal resistance, and is a measure of how well insulation resists heat flow. The higher the R-value, the higher the quality of insulation.

  • Zone 1 - Auckland & Northland Ceiling R 2.9, underfloor R 1.3
  • Zone 2 – The rest area of North Island except Taupo and the Central Plateau – ceiling R 2.9 underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and all of the South Island – ceiling R 3.3 and underfloor R 1.3

Epuni Moisture Ingress & Drainage

Making sure your rental property is protected from dampness isn’t just about the inside of the building; you have to make sure there is somewhere to allow surface, rain and underground water to flow and prevent it from getting into the building.
