Did you know that the Healthy Homes Standards came into effect on the 1st July 2021? Landlords are now required to ensure that their Epuni rental properties meet the minimum Healthy Homes Standards within 90 days of a renewal or new tenancy and all private rental properties are required to be completely certified by 1 July 2024.

Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for an Epuni rental property, all Healthy Homes compliance work have to be done by the end of 90 days.

Since the 1st July of 2021, if a new, renewed or varied contract is signed on the Epuni rental property, all Healthy Homes compliance work must be taken care of within 90 days.

Failure to comply with any of the Healthy Homes Standards by the end of the period of time expected can lead to an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated within the renewal, new or revised tenancy contract, it could result in an additional fine or violation fee.

Any tenant may request information regarding the Healthy Homes Standard and how they relate to the property they live in. If the property manager does not provide the information requested within 21 days of receiving the request, they can be issued an infringement notice and could be fined up to $750.

Additionally, there is also a fine of approximately $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is identified on the tenancy agreement as the one who is renting the property which could be the name of the landlord, or the company that manages the property.

All the information on the Compliance Statement requirements to be up-to-date at the time that the tenancy agreement is signed, and ideally it is updated during the entire tenancy, as relevant work gets completed.

It is also crucial to note that a landlord with multiple rental properties may face even higher fines for non-compliance. The highest penalties are given for severe breaches, and landlords with at least six rental properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

Epuni Healthy Homes Compliance Timeframes

Tenancies signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is required throughout Epuni and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent An Insulation Statement as well as an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Landlords and property managers must keep records that prove conformance with any Healthy Homes Standards that apply or will be in force throughout the tenancy period of an apartment rental.

From July 1st 2021

  • Private landlords and property managers must make sure their rental properties comply to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarding homes (except Kainga Ora and registered Community Housing Provider for boarding household tenancies) must meet the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All households let by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

From July 1st 2024

  • All rental homes have to meet the Healthy Homes Standards regardless of the date when the tenancy started.
Unreasonable Gaps & Holes

Draught Stopping Epuni

Draughts can lead to dropping temperatures within houses. A draughty house is more expensive to heat, resulting in wasted energy and incurring higher costs.

If a draught could be noticed from gaps that are not adequate or holes or holes, it needs to be sealed.

Heating Epuni

Epuni rental properties need to have a stable source of heating which can warm the living room to at least 18degC, even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The heating source needs that it be permanently fixed (i.e., not portable), at least 1.5 kW in heating capacity, and must meet the minimum heating capacity needed for the main living space. A Heating Assessment Tool can be used to check if the existing fixed heater(s) are sufficient or whether you will need to ‘top up’ with a new heater. If the heating system you provide is electric heating or heat source, then it must have a thermostat. This will help make the heating more uniform and efficient. For most homes, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters will be required. In some instances, such as small apartments small apartments, a smaller electric fixed heater could be enough.

If your living space already has a fixed heating source like a heat pump, then it could need an upgrade in order to comply with the standards. Certain kinds of heaters cannot be used to meet the quality since they’re either inefficient, unaffordable to operate and/or unsafe to run.

Ventilation Epuni

Every living space of a rental property must have at least one opening windows or an exterior door to provide natural ventilation. In addition, humid areas such as kitchens and bathrooms must have a suitable externally vented extractor fan to remove moisture.

All bathrooms and kitchens and every other room of your house that houses a bath, shower or cooktop, or any other water-generating appliance will require proper extractor fan systems which are vented out to the outside. Insulation Epuni

Insulation for underfloor and ceilings is required to all rental houses since 1 July 2019. Property managers and landlords must make sure that the insulation meets this new standard. In some instances, existing ceiling insulation or insulation in the subfloor space may require to be topped up or replaced.
