Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed contract is signed on an Eastbourne rental property, all Healthy Homes compliance tasks must be taken care of within 90 days.

Since the 1st July of 2021, if a new, renewed or varied Tenancy is signed for an Eastbourne rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to meet each of Healthy Homes Standards by the end of the deadlines can result in a fine of up to $7200. In addition, there is also a penalty of up to $900 for landlords or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person responsible for this fine is whoever is listed on the tenancy contract as the person letting the property out and it could be the landlord’s name or the company that manages the property.

All the information on the Compliance Statement needs to be correct at the time that the tenancy agreement is signed, and ideally it should be maintained throughout the tenancy as any associated work has been completed.

It is important to remember that landlords who manage several rental properties can face greater penalties for non-compliance. The harshest penalties are given only for serious breaches. Landlords with more than six properties could receive fines of up to $50,000, and even as high as $100,000 in the case of hearing claims.

Tenancies established from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is mandatory throughout Eastbourne and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply as well as an Insulation Statement, and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
