Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied tenancy is signed on an Eastbourne rental property, all Healthy Homes compliance tasks need to be taken care of by the end of 90 days.

Beginning on July 1st, 2021, when a brand new or renewed tenancy is signed on an Eastbourne rental property, all Healthy Homes compliance work must be completed within 90 days.

In addition, there’s also a penalty as much as $900 for landlords and property managers that provide false or misleading Healthy Homes Statement of Compliance or information. The person who is liable for this fine is whoever is named on the tenancy agreement as being the person who is letting the property, so it could be the name of the landlord, or the property management company.

All information in the Statement of Compliance requirements to be current at the time that the tenancy agreement is signed. It should be kept updated throughout the tenancy as any necessary work related to it is finished.

It is also crucial to keep in mind that a landlord who own multiple rental properties could face additional fines for non-compliance. The harshest penalties are reserved for serious breaches, and landlords with six or more properties can be penalised up to $50,000, and as much as $100,000 in hearing claims.

Eastbourne Healthy Homes Compliance Timeframes

Tenancies signed beginning on 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is required in all Eastbourne and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords have to keep records that prove the compliance with the Healthy Homes Standard that apply or will be applicable during the tenure of your rental home.

From July 1st 2021

Rental properties in Eastbourne need to have a stable heating source which can warm the largest or main living space to at least 18degC even on the coldest winter days.
