Fines for Failing to Comply

Since the 1st July of 2021, when a brand new or renewed tenancy is signed for an Eastbourne rental property, all Healthy Homes compliance items need to be finished inside of 90 days.

From the 1st of July in 2021, if a new, renewed or varied contract is signed on the Eastbourne rental property, all Healthy Homes compliance work must be taken care of within 90 days.

The information contained in the Statement of Compliance needs to be up-to-date when the tenancy contract is completed, and should be maintained through the tenancy period as relevant work gets completed.

It’s crucial to note that landlords who own multiple rental properties may face additional fines for non-compliance. The most severe penalties are given only for serious violations, and landlords who own six or more properties could be penalised up to $50,000, and as much as $100,000 in hearing claims.

Eastbourne Healthy Homes Compliance Timeframes

Tenancies that were signed between 1 July 2019 and 30 June 2021

  • Ceiling and underfloor insulation is compulsory for all Eastbourne and New Zealand rental houses where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement must be included in any new, renewed or varied tenancy agreement.
  • Property managers and landlords are required to keep records that prove the compliance with all Healthy Homes Standards that apply or will be in force during the tenure of their rental properties.

From 1 July 2021

Starting 1 July 2024

  • All rentals homes are required to comply with Healthy Homes Standard regardless of the time of the first day of tenancy.
