Fines for Failing to Comply

Since the 1st July of 2021, once a new, renewed or varied tenancy is signed for a Days Bay rental property, all Healthy Homes compliance tasks have to be done by the end of 90 days.

Since the 1st July of 2021, when a brand new, renewed or varied lease is entered into on a Days Bay rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards by the end of the period of time expected can lead to penalties of up to $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t included within the new, renewed or revised tenancy agreement it could result in additional penalties or an infringement fee.

Any tenant may request details about the Healthy Homes Standard and how they relate to the building they are living in. If the property manager does not provide the necessary information within 21 days from having received the inquiry, they may receive an infringement letter and be fined up to $750.

Additionally, there is an additional fine of as much as $900 for property owners or property managers providing a false or misleading Healthy Homes Statement of Compliance or other information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the person who is leasing the property out and it could be the name of the landlord, or the property management company.

The information contained in the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is signed, and ideally it should be maintained throughout the tenancy as any relevant work gets completed.

It’s important to note that a landlord who manage multiple rental properties could face even higher fines for non-compliance. The harshest penalties are given only for serious violations, and landlords who own at least six rental properties could receive fines of up to $50,000, and even as high as $100,000 in hearing claims.

Tenancies established from 1 July 2019 to 30 , June 20,21

  • Insulation of the underfloor and ceiling is required to all Days Bay and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement, an Insulation Statement and an Insurance Statement should be included with any renewal, new or altered tenancy contract.
  • Property managers and landlords must keep records of their the compliance with the Healthy Homes Standards that apply or will apply during the tenure of the rental property.

Beginning 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of any new, renewed , or altered tenant.
  • All boarding houses (except Kainga Ora and registered Community Housing Provider Boarding home tenancies) must adhere to the Healthy Homes Standards regardless of the time the tenancy began.

From 1 July 2023

  • All households rented by Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals homes must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts are a major cause of lower temperatures in houses. A draughty home is more expensive to heat, which means wasting energy and incurring higher costs.

If a draft can be felt through gaps that are too large or holes, it needs to be sealed.

What are the most unreasonable gaps or holes?

If you can feel external air getting in, or see the air is clear from a crack or a gap and you can feel it, it is likely a crack or hole which needs sealing in some way. Cracks or gaps with large gaps must be permanently stopped. Any gaps greater than 3mm that allow air to enter or exit of the home need sealing. For example, if the open fireplace isn’t being used, it can cause draughts and should be shut off. Landlords and property managers are responsible for ensuring such draughts are eliminated as far as imaginable.

You don’t need to block holes or gaps that are part of the building. For example, tiny gaps around doors and windows could be required to allow for the movement of the building as the household gets warmer and cooler, so that they are able to be closed and opened rather instead of being stuck. Proper heating is important to ensure healthy homes

Heating Days Bay

Days Bay rental properties should have a permanent heating source that can heat the largest or main living space to a minimum of 18degC, even on the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The heating source needs that it be permanently fixed (i.e., not portable) and at least 1.5 kW in heating capacity, and meet the minimum capacity for heating required for the main living room. A Heating Assessment Tool can be used to determine if your current fix heater(s) are adequate or whether you will require to "top up" with an additional heater. Open fires as well as unflued combustion heaters like small portable LPG bottle heaters aren’t considered acceptable heating options under the Healthy Homes Standard.

Ventilation Days Bay

Insulation Days Bay

The insulation of the ceiling and underfloor is required to all rental houses as of July 1st, 2019. All landlords and property managers have to make sure that the insulation is up to current quality.
