Healthy Homes Assessment Services

Did you have any idea that the Healthy Homes Standards came into effective on July 1st, 2021? The landlords are now required to make sure that their Days Bay rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy and all private rentals must be completely in compliance by July 1st 2024.

Fines for Failing to Comply

Since the 1st July of 2021, if a new, renewed or varied contract is signed on a Days Bay rental property, all Healthy Homes compliance work have to be taken care of within 90 days.

From the 1st of July in 2021, when a new, renewed or varied Tenancy is signed for a Days Bay rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to adhere to all of the Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy agreement it could result in an additional penalty or infringement fee.

Anyone can request information regarding the Healthy Homes Standard and how they are related to the house they live in. If the property manager fails to supply the required information within 21 days of being informed of the request, they could receive an infringement letter and be fined up to $750.

Additionally, there is also a fine of up to $900 for landlords or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is listed on the tenancy agreement as the one who is letting the property out which could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance needs to be accurate when the tenancy agreement is signed, and ideally it is updated throughout the tenancy as any necessary work related to it’s finished.

It is crucial to remember that a landlord who manage multiple rental properties could face greater penalties for non-compliance. The highest penalties are reserved for serious violations, and landlords who own more than six properties could be fined up to $50,000, and as much as $100,000 for hearing claims.

When should I need to meet The Healthy Homes Standards?

Days Bay Healthy Homes Compliance Timeframes

Tenancies signed from 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is compulsory in all Days Bay and New Zealand rental houses where it’s reasonably practicable to put in.
  • A Healthy Homes Statement of Intent to Comply An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records to demonstrate the conformance to all Healthy Homes Standards that apply or will be applied during the tenure of their rental properties.

From 1 July 2021

  • Property managers and private landlords should ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered for boarding household tenancies) must comply with the Healthy Homes Standard regardless of the date the tenancy was started.

From July 1st 2023

  • All households which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2024

  • All rentals houses have to meet the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Draught Stopping Days Bay

Draughts increase the likelihood of low temperatures inside houses. A cold home costs more to heat, resulting in wasted energy and resulting in higher bills.

If a draught could be felt from unreasonable gaps or holes the area needs to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air flowing in or a clear draught from a hole or gap, then it’s probably a gap or hole which needs sealing in any way. Large cracks and gaps should be fixed permanently. Gaps greater than 3mm that let air into or out into your home need to be sealed. For example, if the open fireplace isn’t in use it can create draughts. This should be sealed off. Property managers and landlords are accountable for ensuring that such draughts are squelched in the maximum extent possible.

There is no need to block holes or gaps which are part of the construction. For example, tiny gaps around doors and windows might be necessary to allow for movement within the structure when the household warms and cools so that they are able to be closed and opened rather instead of being stuck. Heating Days Bay

Rental properties in Days Bay need to have a stable heating source which can warm the living space to at least 18 degrees Celsius, even on the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heating requirements to remain fixed (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity, and it must have the minimum requirement for heat capacity for the main living room. A Heating Assessment Tool may be used to check if the current fix heater(s) are adequate or whether you will require to "top up" by adding a second heater. Open fires and unflued combustion heaters, such as the portable LPG bottle heaters are not considered acceptable heating options in The Healthy Homes Standard.

If the heating you offer is electric heating or heat source, it requirements to be equipped with the thermostat. This makes the heating more uniform and effective. For most properties, larger fixed heating devices such as heat pumps, wood burners pellet burners, flued gas heaters will be required. However, in some cases like apartments with small spaces an electric, fixed heater may suffice.

If your main living space already has a permanent heating source such as an air conditioner, it might just need some additional energy to be able to meet the standards. Certain types of heaters cannot be used to meet the standard as they are either inefficient, unaffordable to operate and/or unhealthy to run.

Ventilation Days Bay

Every living space of a rental home must include at least one open windows or an exterior door to provide natural airflow. Additionally, areas with high moisture spaces like kitchens and bathrooms should be equipped with an externally vented extractor fan to get rid of moisture.

Insulation Days Bay

Insulation for underfloor and ceilings is a requirement on all rental houses since July 1, 2019. Property managers and landlords should ensure that the insulation meets current quality. In some instances, current ceiling insulation, or the insulation of the subfloor space may require to be topped up or replaced.

A well-insulated house will reduce the risk of condensation and reduce the chances of dampness and mould, and it will make it easier to the house to keep heat.

The "R" refers to thermal resistance, and is a gauge of how well the insulation withstands heat flow. The higher the R-value, the better the insulation.
