Fines for Failing to Comply

Since the 1st July of 2021, when a new or renewed contract is signed on an Arakura rental property, all Healthy Homes compliance work have to be completed inside of 90 days.

Since the 1st July of 2021, when a new, renewed or varied contract is signed on the Arakura rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Furthermore, if a currently-in place Healthy Homes Statement of Compliance isn’t included in a new, renewed or amended tenancy agreement it could result in an additional penalty or infringement fee.

Every tenant is entitled to request information regarding the Healthy Homes Standard and how they relate to the home they are living in. If the landlord or property manager fails to supply the required information within 21 days of being informed of the request, they could be issued an infringement notice and be fined upto $750.

In addition, there’s also a penalty of up to $900 for property owners or property managers that provide false or misleading Healthy Homes Statement of Compliance or any other information. The person responsible for this fine is whoever is named on the lease contract as the person letting the property out which could be the name of the landlord or the property management company.

The information contained in the Statement of Compliance requirements to be accurate when the tenancy contract is executed, and it should be kept updated throughout the tenancy as any associated work has been completed.

It’s also important to be aware that landlords who have multiple rental properties may face more severe penalties for not complying. The most severe penalties are given for the most serious breaches, and landlords with six or more properties could be fined up to $50,000, and even as high as $100,000 in hearing claims.

Arakura Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 and the 30th June in 2021

  • Insulation of the underfloor and ceiling is compulsory to all Arakura and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement An Insulation Statement as well as an Insurance Statement must be included in any renewal, new or modified tenancy agreement.
  • Landlords and property managers must keep records that prove conformance with each Healthy Homes Standard that apply or will apply during the tenure of the rental property.

From July 1st 2021

  • Property managers and private landlords should ensure their rental properties comply to the Healthy Homes Standard within 90 days of any newly renewed, extended or changed tenancy.
  • All boarder households (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must meet the Healthy Homes Standard regardless of the date when the tenancy started.

Starting 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Starting 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standards regardless of when the tenancy first began.

Draught Stopping Arakura

Draughts are a major cause of less temperature in households. A cold house costs more to heat, which results in wasting energy and increased bills.

What are unjustifiable gaps or holes?

If you can feel external air entering or a clear draught from a gap or hole or crack, then it’s likely to be a gap or an opening that needs sealing in some way. Large gaps and cracks should be stopped permanently. Any gaps greater than 3mm that let air into or out into the home require sealing. For example, if an open fireplace is not in use, it could cause draughts, and should be sealed off. Property managers and landlords are accountable for making sure that such draughts are squelched as far as possible.

You don’t need to block off holes or gaps that are part of the construction. For instance, small gaps around doors and windows may be required to allow movement of the building as the house heats and cools, to allow them to be closed and opened rather than being stuck. Proper heating is important for healthy homes

Heating Arakura

Rental properties in Arakura must have a fixed heating source that is able to heat the main or largest living space to a minimum of 18degC, even on the most coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heating requirements that it be permanently fixed (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity, and meet the minimum requirement for heat capacity in the living area. A Heating Assessment Tool may be used to determine whether the fix heater(s) are adequate or whether you will require to "top-up" with an additional heater. Open fires and unflued combustion heaters like small portable LPG bottle heaters aren’t considered to be safe heating options in the Healthy Homes Standard.

If the heating system you offer is electric heating or heat pump, it must have a thermostat. This will help make your heating more consistent and efficient. In most houses, larger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters are needed. However, in certain instances like small apartments an electric, fixed heater may be sufficient.

If your main living space already has a fixed heating source like the heat pump, it might just need some additional energy to be able to meet the standards. Certain kinds of heaters cannot be used to meet the standard as they are either costly, not affordable to run, and/or unhealthy to run.

Ventilation Arakura

Every living space of a rental property has to contain at minimum one open windows or an exterior door to provide natural airflow. In addition, high moisture areas such as kitchens or bathrooms need to have an externally vented extractor fan to get rid of moisture.

Underfloor and ceiling insulation is a requirement for all rent houses from 1 July 2019. Property managers and landlords must make sure that the insulation is up to this new quality. In some instances, current ceiling insulation, or the insulation of the sub floor space may require to be filled with or replaced.
